These TRK Terms and Conditions apply to Clients of The Right Kit.  If You do not understand these Terms or have any questions about the Products, Services or Website, please contact Us using any of the methods below:

Definitions

“Terms” means these Terms and Conditions.  The Right Kit reserves the right to revise these Terms at any time.  The most up to date version will always be found on the Website.

“You/r,” “Client/s”, ” “User/s” means all individuals and/or entities that use or have used the Website or who have purchased or booked Products/Services from The Right Kit.

“TRK” is The Right Kit.

“Website” refers to the contents of www.rightkit.co.uk, which includes but is not limited to text, images, audio content, videos, designs, graphics, information, logos, downloadable content and software under TRK’s control.

“Recovery Procedure” is a process to protect TRK from unlawful actions, which will be activated where there is evidence that these Terms have been breached in any way.  See below.

“We,” “Us,” and “Our” means and refers to TRK.

“Privacy Policy” means the TRK Privacy Policy.  See below.

“Cookies Statement” means the TRK Cookies Statement.  See below.

“Product/s” and “Service/s” mean the items advertised, available and offered either online or direct to the public at an outlet operated by TRK.

You will be asked to accept these Terms before You complete Your online order.  If You do not click the “I Accept” button You will be unable to proceed with Your transaction.

These Terms together with emails and written or typed communications, form the basis of a contract between You, Your agents and TRK.  Any variation or modification shall be effective only on the written agreement of all parties involved.

TRK reserves the right to revise these Terms at any time.  The most up to date version will always be found on the Website.  Please visit this page periodically to review Our current Terms.

If You access the Website from overseas, You do so at Your own risk and are responsible for compliance with the laws of Your own country.

Intellectual Property

The Website, its contents, code, copy and design are the property of TRK.  Unauthorised use of the Website is strictly prohibited. You agree not to copy or adapt the Website or any part thereof, without prior written authorisation from TRK.  The images taken by TRK are the property of TRK and unauthorised use of them is strictly prohibited.  You agree to not copy, alter, sell, distribute, publish or reproduce material or any part thereof belonging to TRK whether purchased or not, without permission.

Law

The laws of England shall apply to these Terms.

Liability

In the event of a claim, Our liability is limited to the total of all payments received in respect of the Products or Services purchased. Where there is a partial loss, a partial return will be made.

Links

The Website may contain links to third-party websites. These links are provided as a convenience not an endorsement.  TRK is not responsible for the content of linked third-party websites. Your use of third-party websites is at Your own risk.

Payment

Full payment is due at the point of purchase for Products and Services.  For corporate orders, invoices must be paid within 14 days.

Postage & Delivery

Within the UK, We will post Your purchases using Royal Mail.  Postage costs will be communicated to You by email or when You have put something in Your basket and begin the check-out process.  Make sure Your delivery address is correct and appropriate to receive a signed for parcel if You select that option. 

Please note that for international orders, customs and import duties may also be applied.  These will vary from country to country. It is Your responsibility to check with Your local customs office whether the country to which You request shipping, permits the shipment of Your purchase

The Right Kit uses and reuses recyclable packing as far as possible. 

Pricing

The price displayed for each TRK Product on the Website represents the full price excluding gift wrapping and postage.  Pricing may be slightly different at events where TRK products are being sold direct to the public.  Please let Us know immediately if You feel a product is mispriced. 

Prices may be increased without warning but will always reflect known costs.  TRK does not provide price comparison or matching facilities and takes no responsibility for alternative pricing that may be available elsewhere.  You can pay using cash, PayPal or by submitting Your credit or debit card details with Your order.

Products and Services

The description of Products and Services is set out on the Website and other forms of advertising.  All Products and Services are subject to availability.  We will do Our utmost to communicate any size and discrepancy issues as We become aware of them. 

The Products will be of the quality and description We have supplied and be fit for purpose for at least 12 months.  If You find this is not the case, please let Us know immediately.

Purchases

Purchases can be made online by visiting www.rightkit.co.uk, or in person, by telephone, text or by using email.  Please note:

  • If Your order cannot be fulfilled for whatever reason We will let You know as soon as possible.
  • You will be able to check and amend any mistakes in Your order, delivery address and payment method before You make Your purchase on or offline.
  • Online purchasers will receive an order confirmation – please check this carefully.
  • Offline purchasers can either leave their email address at the point of sale so that they may be sent these Terms or they can find them online.

Once You receive Your order it is Your responsibility to check all components are present and correct in relation to your order and to notify Us of any issues.

Usage

You agree that You will not Use the Website and images derived from the Products and Services of TRK in a manner that is illegal or otherwise inconsistent with these Terms.  We reserve the right to restrict, suspend, or terminate Your access to the Website without notice for any reason. 

You agree that You will access the Website only through the interfaces provided. You agree not to reverse-engineer or otherwise hack the Website, not to take any actions that damage the Website or its security or interfere with other Users’ use of the Website.

Returns Policy

We recognise that things can and occasionally do go wrong.  If We have made a mistake or something unexpected happens please let Us know as soon as possible and We will do Our best to remedy the situation.  Please give Us the opportunity rectify any issues or complaints.  We will consider Your claim and make every, commercially reasonable effort, to reach a satisfactory resolution. 

Let Us know by email if You need to change something.  Tell Us what You have and what You’d prefer so that We can plan.

Credit notes, replacements and refunds will reflect the condition of the returned products. Returns that show signs of having been opened, used or damaged will receive a reduced credit note or partial refund at Our discretion.

Please agree the address and method of postage before you return your purchase. We strongly recommend You protect the goods You wish to return, against damage whilst in transit with secure packaging , suitable insurance and that You use a trackable method of delivery.  Please retain Your proof of postage. 

For a full statement of your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and details of the Distance Selling Regulations in the UK please contact your local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office.

Where we have delivered products to a third party in accordance with your order, you will only be able to exercise your right to cancel if the goods are returned to us.

Faulty Goods

Replacements will be given for products that are found to be damaged or faulty. In this instance, please email info@rightkit.co.uk within 14 days of receiving Your order to explain the issue and attach Your receipt and supporting images.

Credit notes, replacements and refunds will reflect the condition of the returned products. Returns that show signs of having been opened, used or damaged will receive a reduced credit note or partial refund at Our discretion.

If your product needs to be returned, please agree the method of postage and address before you send your products and only return your products when requested. 

Claims made after 28 days from receiving Your order will be accepted at discretion of TRK.  

Withdrawal

If You no longer want the Products You purchased following an online, telephone or postal order, email info@rightkit.co.uk within 14 days of receiving Your order, to explain that You want a refund and include your receipt and supporting images.

Please agree the address and method of postage before you return your purchase. 

We will refund an amount reflecting the condition of the returned Products as long as they have reached Us within 28 days of You receiving Your order.  A credit note will be issued for purchases where the products are not returned within 28 days.

Changed your mind?

As long as You didn’t make an online, telephone or postal order, You will be entitled to a credit note valid for 12 months for an amount reflecting the condition of the returned Products once they have reached Us, if you have changed Your mind and no longer want the Products You purchased,

In the first instance email info@rightkit.co.uk within 14 days of Your purchase to explain that You have changed Your mind and include your receipt and supporting images.

Remember that We are not obliged to give You a refund if You have simply changed Your mind.

Recovery Procedure

If You fail to pay an invoice or otherwise breach these Terms, this Recovery Procedure will be used to protect The Right Kit from:

  • Loss of income, profits & earnings
  • Copyright Theft
  • Unauthorised and /or unattributed use of or orphaning images
TRK may be entitled to:
  • Compensatory Damages – where images have been used without having been paid for
  • Further damages – for failure to credit an image (breach of statutory duty under S.103 of the Copyright, Designs and Patents Act) and for any derogatory treatment of the image/s.
  • Additional damages – where the breach is flagrant or where You have gained a benefit from using the image/s and for ‘moral prejudice’ under S.3(2)(a)(ii), The Intellectual Property (Enforcement, etc.) Regulations 2006.
  • Request an account of profits from Your use of the image.
  • Request that You carry out disclosure of the full amount of profits derived from use of the image/s
  • Reclaim Lawyers’ fees, court fees, and other expenses related to the matter.

These Terms and emails or other correspondence between Us will determine the permissions You have regarding the images and the infringements.  If You are unsure whether You have the authorisation to use an image, please ask.  Any breaches of these Terms will be noted and communicated to You with the appropriate remedy.  If after 7 days, the matter is not resolved TRK will make a settlement offer.  If the settlement offer is not paid within 14 days legal proceedings will commence.

Privacy Policy

We will retain all personal details You have supplied to facilitate future correspondence.  The information You give Us voluntarily will never be passed on and is only used by Us in connection with competitions, offers, news and tips, specific enquiries, commissions, requests or to send information regarding Our Products or Services. We will not delete or destroy correspondence or Your contact details unless otherwise instructed.

Tell Us if You want know what We hold, or want to see the information You gave Us, or think it is incorrect and want to change it.  We are not responsible for the data policies, procedures or content of any sites linked to Ours.  Let us know if You want to be removed from Our database.

We have taken steps to ensure Your information is accessible to You, secure, accurate, and protected by Us.
